& John Harrell
WHEREAS, at the Ooctober Term of this Court, last past, a Rule
Ni Si was granted in the above case, requiring the Defendant to pay to the Plaintiff
the pricipal, interest and cost, due on a certain note given by
the Defendants on the first day of October 1855
and to become due on the first day of October 1856
for the sum of Three thousand Dollars
for the better securing the payment of which said note, said Defendants had executed
on the Second day of October 1855 to the Plaintiff these
Deed of Mortgage, conveying to said Plaintiff that certain piece of town
property lying & being in the town of Bainbridge in said County
& known in the plan of said town as town lots number nine (9) no. 10
no. 11 & number 12 being the place known as the town lot on which situate
the Hotel known as the Harrell Hotel together with
all of said lots situate & lying in the garden lots, stable
lots & other lots to the said William W. & John attached & belonging thereto
the number of acres not known with all the rights & appurtenances to the
said tavern lot in any waise appurtaining and belonging.
Conditioned to be void upon the payment of the principal and interest of said note:
And it appearing to the Court that a copies of said Rule Ni Si has been served on the
Defendents William W. & John Harrell and that said
defendants still neglect and refuse to pay the amount due on said note.
It is therefore considered and adjudged that the equity of redemption in and to said
mortgaged premises be and the same is hereby barred and forever foreclosed; and it
is further ordered that the Plaintiff do recover of and from Defendant the sum of
Three Thousand dollars and _____ cents
for his principal, and the sum of one hundred & twenty two dollars and
fifty cents for his interest and the sum of Six 25/100
dollars for his cost : and that execution issue against said mortgage premises for the
sum aforesaid, and that the Defendant in mercy. Judgment signed this first
day of May 1857.

"Death of an Old Citizen
Mr. John Harrell of this county, one of our oldest and best known citizens, died very suddenly at his residence eight miles from Bainbridge, on Thursday night the 20th inst. The deceased was a very old man, being seventy-six years of age, and having a very large progeny in this county-numbering among them numerous grand and great-grand children. He went to bed after supper apparently in his usual good health, and was found dead the next morning. Mr. Harrell has been a resident of this county for a long number of years, and was regarded very highly for his many good qualities by all who knew him." |
