Lane late of Said County deceased which have or shall come into the hands possession or knowledge of the Said James Bird or the hands or possession of any person or persons for him & the same so made do exhibit unto the said Inferior court when sitting as a court of Ordinary when he shall be thereunto required & such goods Chattels & Credits do well & truly administer according to law and do make a just & true account of his actings & doings therein where he shall thereunto be required by the court & shall deliver & pay to such person or persons respectively as they may be entitled to the same by Law. And if it shall hereafter appear that any last will & Testament was made by the deceased & the same be proven before the said court and Executor obtains a certificate of the probate thereof, and the said James Bird as such case if required render and deliver up the siad letters of administration then this obligation to be void else to remain in full force. - State of Georgia In the name of God amen I James Bird of the County and State
Decatur County aforesaid, calling to mind that all men must die, do make and ordain this my last will and testament, hereby revoking all other will or wills by me made heretofore or published.
First. It is my will that my executors hereafter nominated, and appointed shall so soon after my death as practi[c]able pay all of my just debts, and the necessary expenses of my last sickness.
Secondly. It is my will that my executors deliver to my son Richard L. Bird upon his arriving at the age of twenty one years or marriage a negro Boy or fellow out of my negro property also a good Horse Bridle & Saddle, and a good Bed and furniture, which will make him equal in advancement to the balance of my children heretofore provided for, provided that he is not advanced before my death.
Thirdly. It is my will that the remainder of my property both real and personal shall go to and be the sole and separate property of my beloved wife Nancy Bird forever in fee Simple. Provided she shall survive me.
Fourthly. I do hereby nominate constitute and appoint my said wife Nancy Bird and my son in Law Drayton Blackburn my Executors to this my last will and testament.
In testimony whereof I have hereunto set my hand and seal and delivered the same in the presence of this 17th day of July 1852

And that he saw James E. Martin and Archibald S. Curry Subscribe the same as witnesses, and in the presence of and at the request of said Testator.

It is further ordered that a warrant of appraisement do issue to Isaac Ferguson, James Martin, Saml Fairchilds, Edward Wooten, and _____ Trawick, who are hereby appointed appraisers of the Estate of said James Bird Decd.
