Georgia, Terrell County In the name of God Amen
I Cain Wall of the County and
State aforesaid. Being of Sound
and disposing mind and memory, and being
desirous to Settle my Worldly affairs, while I have
strength so To do, do make and publish this my
last will and Testament, hereby revoking all wills
by me at anytime made heretofore; and first I
commend[?] my soul to God who gave it; and my
body I desire to be buried in a decent and chris
tian like character suitable to my circumstances
and condition in life, and my worldly affairs I
dispose of as follows:
First I desire and direct that all my Just debts be paid
without delay by my Executors hereinafter named
and appointed.
Secondly. I give bequeath and devise to the following children
viz Jesse E. James L. Lucinda A. Charles F. Ann
Eliza, and John Melton Wall all the money, notes
and accounts, I may have own and possess at the
time of my death, to be equally divided among them
and should my wife Elizabeth Wall give birth to a
child within nine months from the date of my
death said child shall share equally with the above
named children in said notes, money and accounts
all to share equally and alike.
Thirdly, I give and bequeath and devise to to my beloved
wife Elizabeth for her own Exclusive use and ben
efit in Lieu of Dower five hundred dollars ($500.00)
to be paid her by my Executors, out of the proceeds
of the sale of Real and Personal property; Said five
hundred dollars is given to her in full Extinquishment
of her whole rights of Dower in my Real Estate; and
in lieu of Twelve months support for my wife and
minor children, I give to my said wife fifty Dollars in
cash, and the same amount for each of my minor
children who may live with her, for the first year
after my death, to be paid out of the proceeds arising
from the sale of Land. I make this bequest as
set forth in this Item of my will so that no Dower
may be allowed her out of my lands and nothing set apart
for her support for the twelve months Except as herein
named.
Fourthly, I give bequeath and devise to the following
named of my children and grand children
to wit Elafair R. Temperance B.[or R?] Martha A. Tig[?]
and Grand child Torancie[?] daughter of Th[?]
Wall deceased fifty Dollars each to be paid out
by my Executors, out of money arising from the Sale of Real
and Personal property
Fifthly, I give bequeath and devise to my Son Wm E G Wall R[?]
A. and Sarah [L?] Wall, Mrs. Jane F. Dale Mrs. Sarah
Kennedy, and to the children named herein before, in
2d Item of this my last will to wit. Jesse E. James S. Lucus
A. Charles F. Ann Eliza & John Melton Wall. The residue of
my Estate, both real and personal to share equally and ali[ke?].
Sixthly I hereby constitute and appoint William E G Wall and Lee C. Hoyle Executors of this my last Will and Testament with power and authority to sell and dispose of the property I may leave, both real and personal as they may think best for my heirs, either at public or private sale, and without any order of Court, to carry out this my will as herein directed.
Eighthly I desire, request, and direct that my Executors so named, and the Guardian also, give bond and Security in the usual way, for the faithful discharge of this di[?]
