To the Hon T B Maxwell Ordinary of Said County
The petition of J T Powell respectfully shows.
First: That on the 22nd day of April 1912 Jesse H Powell
made and executed to your petitioner a bond for title, conditioned
to convey to your petitioner the land described in said bond for
title upon petitioners complying with the conditions therein spec-
ified. A copy of said bond for Title is hereto attached, marked Ex-
hibit "A," to which the usual leave of reference is prayed
2nd: Petitioner shows that he has complied with each and
every condition of said bond for title and has fully paid off the principal
and interest represented by the notes mentioned in said
bond for title
3rd: Petitioner shows that the said Jesse H Powell died shortly
after executing said bond for title, and that Mrs Nannie Powell has been
appointed Administrator of his estate
Wherefor Petitioner prays that the notice required by law be
given, and that an order be passed directing the Administratrix to make
and execute to petitioner a deed in compliance with said bond for title

Georgia Decatur County.
Know all Men by These Presents, That Jesse H Powell of the
County and state aforesaid, party of the first part is held and
firmly bound unto J T Powell, party of the second part, his heirs
and assigns, in the penal sum of Two Thousand Six Hundred and
sixty seven and 50/100 (2,667.50) Dollars for the payment of which well
and truly to be made the said party of the first part, hereby binds him-
self and his heirs, executors and Administrators, jointly severally
and firmly by these presents. Signed with his hand and sealed
with his seal, this the 22nd day of April 1912
The condition of the foregoing obligation is that whence the said
party of the first part has this day agreed to sell the said party of the
second part a certain tract or parcel of land situate, lying and being in the
27 District of Decatur County Georgia, and known and described in the
said District as all of the East half (E 1/2) of lot of land number Two Hundred
seventy Four (274), said East half (E 1/2) containing One Hundred Twen-
ty Five acres more or less (125 A) for the consideration or sum of One
Thousand Three Hundred and Thirty Three and 75/100 (1333.75) Dollars
which said sum is to be paid as follows
Two Hundred and Twenty Two and 29/100 (222.29) Dollars
due and payable on the first day of November 1912. Two Hundred and
Twenty Two and 29/100 (222.29) Dollars due and payable on the first
day of November 1913. Two Hundred Twenty Two and 29/100 (222.29)
Dollars due and payable on the first day of November 1914 Two Hundred
and Twenty Two and 29/100 (222.29) Dollars due and payable on November
1st 1915. Two Hundred and Twenty Two and 29/100 (222.29) Dollars due and
payable on the first day of November 1916, and Two Hundred Twenty Two
and 30/100 ($222.30) Dollars due and payable on the first day of November 1917. For
which defered payments the said party of the second part has given six
(Promisory) notes dated this day, bearing interest at the rate of six percent
per annum from January first 1912, until paid, and stipulating that
the said party of the second part shall pay attorneys fees and cost of
suit should suit be instituted.
The Vender having given six (6) notes for the defered payments for
the above sescribed tract of land, aggregating one thousand three Hundred
and thirty three and 75/100 ($1,333.75) Dollars, it being expressly agreed
that time is of the essence of this trade, he hereby agrees that if any
one of said notes shall become due and remains unpaid at any one time
longer than ten days after Maturity, then all the remaining unpaid
notes shall be considered as due; and the right of action on all of the
unpaid notes for principal accrued interest, attorneys fees of 20% and
all Court Cost shall at once exist.
Now, if the said party of the second part shall well and truly
pay the said several sums of money at the time specified, then the said
party of the first part is hereby bound to make and execute to the said
party of the second part or his assigns a good and sufficient title
to the above described lot or parcel of land; but on failure of the
said party of the second part to pay the said sums of money or either
of these at the time specified, then the said obligation to be void
and of no effect.
In witness whereof, the said party of the first part has
hereunto set his hand, affixed his seal and delivered these
presents the day and year above written

Mrs Nannie Powell Admx of Petition for order requiring
the estate of Jesse H Powell deceased Administratrix to make Title
This case coming on regularly for a hearing and it appearing that
all respondents therein have been properly notified and the notice
required by law published in the official organ of Decatur County
for the term required by law, and no objection having been filed, and no
one appearing to make objections to the granting of the application, and
it further appearing that the matter and things set out in said petition
are true; that the bond for title was executed at the time
specified and the indebtedness mentioned in said bond
for title having been fully paid off and discharged;
Wherefor, it is considered, ordered and adjudged that
the said Mrs Nannie Powell, as Administratrix of the Estate
of Jesse H Powell, deceased, do and she is hereby required
to make to J T powell a deed conveying full and sufficient
title to all of the property mentioned in said bond for title
to wit:
A certain tract or parcel of land situate, lying and
being in the Twenty seventh (27th) District of Decatur County
Georgia, and known and described in the said District as all
of the East half of lot of land number Two Hundred and seventy
Four (274) said East half containing one hundred and
Twenty five (125) acres more or less.
Said deed to specify the consideration of Thirteen Hundred
and Thirty Three Dollars and seventy five cents ($1333.75)
It is further ordered that the cost of these procedings
be borne by the applicant J T Powell

- Jesse Thomas Powell Dies In Brinson
Mr. Jesse Thomas Powell, age 68, died at his home in Brinson on June 13, after an illness of about three years. Funeral services were held at the Baptist Church in Brinson at 5:00 p. m. on June 15, with Reverend E. R. Broadwell officiating, assisted by Reverend Marvin Vincent. Interment followed in Bethel Cemetery.
The deceased is well known in Decatur County, having been very prominent in farming circles. Although he had been in ill health for several years, his death came as a shock to his many friends and relatives throughout this section of the State.
Mr. Powell is survived by his wife and two daughters Miss Nellie Louise Powell and Mrs. Minnie Powell Earp, all of Brinson; two sons, Curtis Wilmer Powell and J. T. Powell, also of Brinson and four sisters, Mrs. P. D. Rich and Mrs. J. B. L. Barber, of Bainbridge, Mrs. Cliff Sims, of Brinson and Mrs. Claude Lums, of Miami, Fla.
Serving as active pallbearers were Messrs. Perry D. Rich, Jr., Hoke Bush, Lamar Powell, Ross Rich, Jesse Donalson, Alee Rich, Lloyd Rich, and Bill Rich.
Honorary pallbearers included Messrs. M. E. O'Neal, W. J. Catledge, H. G. Bell, C. S. Hodges, T. L. Hodges, Percy Yoimans, D. K. Tolbert, Paul F. Watts, C. P. Kageryon, D. W. Hodges and W. B. Jackson.
