      KNOW ALL MEN BY THESE PRESENTS, that we John W. Clay, Lewis Clay, John Powell, David Ford, & Kingen Dail, Securities acknowledge ourselves jointly and severally bound unto Lendwell M. Dennard Ordinary of said County, and his successors and assigns, in the just and full sum of Ten Thousand Dollars to the payment of which, well and truly to be made, we bind ourselves, and the heirs and executors of us, and each of us, jointly and severally, by these presents.
      Sealed with our Seals, and dated this Eighth day of September 1856.

      The Condition of the above bond or Obligation is such, That if the above bound John W. Clay who has this day appointed Guardian of the person and property of David H. Clay and Sarah A. Clay Orphan Child of Edmund B. Clay deceased, who acknowledging of the same by his acceptance of said appointment, and of Letters of Guardianship of this date, shall well and truly maintain, clothe and educate said Orphans according to their circumstances, and shall take good and lawful care of them person and property, according to the laws of this State, and shall annually make a just and true return of all his actings and doings herein, unto the said Ordinary, and pay over all assets that may remain in his hands, when said Guardianship shall legally terminate, then this Obligation to be void, else to remain in full force.

    • An entry for "Clay, guardian for Nancy and David H. Clay" was listed in this 1860 tax digest. In comparing this entry to the 1856 tax entry, it appears that "Sarah A." is the same person as "Nancy," and that the unanmed Clay is that of Lewis Clay, Nancy and David H. Clay's uncle (brother of their deceased father, Edmond B. Clay). A reasonable explanation for the name difference is that her full given name is Sarah Ann, and that Nancy was considered a nickname for Ann in the 19th century (see http://www.cslib.org/nickname.htm). In 1850, she was enumerated as "Nancy Clay," aged 6 years, in the household of her mother (also Sarah A. Clay). By 1860, a 17-year old Sarah A. Clay, niece of Lewis, was living in his household in the 1860 census enumeration. Her mother had died less than 12 months prior to this census, so it follows that she moved in with her uncle and guardian.

      Under this guardianship entry in the 1860 tax digest were listed 3 slaves for Nancy, valued at $2,700.00, plus $969.00 in aggregate money and debts; and 3 slaves for David H., valued at $2,200, plus $963.00 in aggregated money and debts.

    • This range is proposed because Nancy's first daughter, Sallie Haynes, was born in November 1864 in Terrell County. Sallie's father, Charles E. Haynes, died in May 1865 during the Civil War. The widow Sarah A. (AKA Nancy) Clay Haynes and her daughter Sallie probably moved after the death of Charles, but before 14 January 1868 when Nancy was married to Jesse. H. Powell in Decatur County.       Jesse H Powell, a resident of said county until his death
      which happened on the 7th day of January 1913, has left
      a considerable estate, real and personal, in said state, and that
      he died without a will; that on account of the time required
      by law to advertise for Permanent Letters of Administration, and the
      circumstances of the estate of said Jesse H Powell, deceased, great loss
      and injury may happen, unless temporary Administration is
      granted immediately on said estate, and that she is entitled by
      law to be appointed Administrator of said estate she being
      the wife of said Jesse H Powell, deceased;
      Petitioner would further state that she is a resident of said
      state, and that the estate of said Jesse H Powell, deceased, is
      worth about one ThousandDollars.

      take care of, and to preserve from waste the real and personal estate of the said
      Jesse H Powell in terms of the law, to the use, benefit, and
      behoof of those who have a right thereunto.
      And you, the said Mrs Nannie Powell, will take into your hands
      and possession, and keep safe from any waste, all the goods and chattels, rights and
      credits, of him, the said Jesse H Powell, deceased, until due
      and legal administration can be had thereon. And that you do make, or cause to be
      made, a true and perfect inventory of all and singular the goods and chattels, rights
      and credits, of the said Jesse H Powell, deceased; and the
      same, so made, you return into my office on or before the 1st Monday in
      Feby next. And, lastly, I do hereby constitute and appoint you, the

      Whereas, J H Powell, of this County, lately died
      intestate; having while he lived, and at the time of his death, divers land and
      tenements, goods, rights, and credits within the County aforesaid, by means whereof
      the full disposition and power of granting the administration of all and singular the
      goods, rights, and credits of the said deceased, and also auditing the accounts, cal-
      culations, and reckonings of said administration, and a final dismission of the same,
      to the Ordinary of said County do of right belong:
      I, desiring that the lands and tenements, goods, rights, and credits of said de-
      ceased may be well and truly administered, converted, and disposed of, do hereby
      grant unto Mrs Nannie Powell

      The petition of J T Powell respectfully shows.
      First: That on the 22nd day of April 1912 Jesse H Powell
      made and executed to your petitioner a bond for title, conditioned
      to convey to your petitioner the land described in said bond for
      title upon petitioners complying with the conditions therein spec-
      ified. A copy of said bond for Title is hereto attached, marked Ex-
      hibit "A," to which the usual leave of reference is prayed
      2nd: Petitioner shows that he has complied with each and
      every condition of said bond for title and has fully paid off the principal
      and interest represented by the notes mentioned in said
      bond for title
      3rd: Petitioner shows that the said Jesse H Powell died shortly
      after executing said bond for title, and that Mrs Nannie Powell has been
      appointed Administrator of his estate

      County and state aforesaid, party of the first part is held and
      firmly bound unto J T Powell, party of the second part, his heirs
      and assigns, in the penal sum of Two Thousand Six Hundred and
      sixty seven and 50/100 (2,667.50) Dollars for the payment of which well
      and truly to be made the said party of the first part, hereby binds him-
      self and his heirs, executors and Administrators, jointly severally
      and firmly by these presents.Signed with his hand and sealed
      with his seal, this the 22nd day of April 1912
      The condition of the foregoing obligation is that whence the said
      party of the first part has this day agreed to sell the said party of the
      second part a certain tract or parcel of land situate, lying and being in the
      27 District of Decatur County Georgia, and known and described in the
      said District as all of the East half (E 1/2) of lot of land number Two Hundred
      seventy Four (274), said East half (E 1/2) containing One Hundred Twen-
      ty Five acres more or less (125 A) for the consideration or sum of One
      Thousand Three Hundred and Thirty Three and 75/100 (1333.75) Dollars
      which said sum is to be paid as follows
      Two Hundred and Twenty Two and 29/100 (222.29) Dollars
      due and payable on the first day of November 1912. Two Hundred and

      payable on the first day of November 1916, and Two Hundred Twenty Two
      and 30/100 ($222.30) Dollars due and payable on the first day of November 1917. For
      which defered payments the said party of the second part has given six
      (Promisory) notes dated this day, bearing interest at the rate of six percent
      per annum from January first 1912, until paid, and stipulating that
      the said party of the second part shall pay attorneys fees and cost of
      suit should suit be instituted.
      The Vender having given six (6) notes for the defered payments for
      the above sescribed tract of land, aggregating one thousand three Hundred
      and thirty three and 75/100 ($1,333.75) Dollars, it being expressly agreed
      that time is of the essence of this trade, he hereby agrees that if any
      one of said notes shall become due and remains unpaid at any one time
      longer than ten days after Maturity, then all the remaining unpaid
      notes shall be considered as due; and the right of action on all of the
      unpaid notes for principal accrued interest, attorneys fees of 20% and
      all Court Cost shall at once exist.

      Now, if the said party of the second part shall well and truly
      pay the said several sums of money at the time specified, then the said
      party of the first part is hereby bound to make and execute to the said
      party of the second part or his assigns a good and sufficient title
      to the above described lot or parcel of land; but on failure of the
      said party of the second part to pay the said sums of money or either
      of these at the time specified, then the said obligation to be void
      and of no effect.

      the estate of Jesse H Powell deceased Administratrix to make Title

      This case coming on regularly for a hearing and it appearing that
      all respondents therein have been properly notified and the notice
      required by law published in the official organ of Decatur County
      for the term required by law, and no objection having been filed, and no
      one appearing to make objections to the granting of the application, and
      it further appearing that the matter and things set out in said petition
      are true; that the bond for title was executed at the time
      specified and the indebtedness mentioned in said bond
      for title having been fully paid off and discharged;
      Wherefor, it is considered, ordered and adjudged that
      the said Mrs Nannie Powell, as Administratrix of the Estate
      of Jesse H Powell, deceased, do and she is hereby required
      to make to J T powell a deed conveying full and sufficient
      title to all of the property mentioned in said bond for title
      to wit:
      A certain tract or parcel of land situate, lying and
      being in the Twenty seventh (27th) District of Decatur County
      Georgia, and known and described in the said District as all
      of the East half of lot of land number Two Hundred and seventy
      Four (274) said East half containing one hundred and
      Twenty five (125) acres more or less.
      Said deed to specify the consideration of Thirteen Hundred
      and Thirty Three Dollars and seventy five cents ($1333.75)

      The petition of W G Powell of said County respectfully shows
      1st That petitioner is the son and oldest child of Mrs Nannie
      Powell
      of Decatur County Georgia.
      2nd That the nearest adult relatives of Mrs Nannie Powell
      residing in the state of Georgia are J T Powell, son, Mrs Euzema Rich, Daughter,
      Mrs A J Rich, daughter, Mrs Byron Donalson, daughter, Mrs J B L Barber, daughter,
      of Decatur County, Georgia, and Mrs P D Rich, daughter of Miller County
      Georgia, and while the law only requires notice to three adult relatives
      Petitioner has given notice to all of the above named relatives of Mrs
      Nannie Powell of this application.
      3rd That Mrs Nannie Powell is Seventy-five (75) years of age
      and is imbecile from old age and is incapable
      of managing her estate.
      4th That Mrs Nannie Powell is the owner of and possesses
      a large estate, consisting principally of notes and money.
      5th That Mrs Nannie Powell at times is seemingly rat-
      ional, and at such times apparently realizes her condition
      and has asked petitioner to make this application and have him-
      self appointed guardian so that he can manage her affairs.
      6th Petitioner shows that from old age Mrs Nannie
      Powell is incapable of properly handling or conducting her affairs
      cannot remember the amount of money which she has
      or the number of notes outstanding nor who is in charge of
      her affairs as her agent.
      7th Petitioner is prepared to prove that ten days notice
      of this application has been given to the three nearest adult
      relatives of Mrs. Nannie Powell
      Wherefore Petitioner prays:
      1st That a commission shall be issued by your Honor
      directed to eighteen discreet and proper persons one of whom
      shall be a physician, requiring and twelve of them including
      the physician to examine by inspection the person
      of Mrs Nannie Powell.
      2nd That such commission be sworn by some officer
      of this state authorized by the laws of this state to administer an
      an oath, well and truly to execute said commission to the
      best of their skill and ability which oat shall be returned
      with their virdict.
      3d That after the return of said verdict that your
      Honor appoint petitioner as guardian for the said Mrs
      Nannie Powell and petitioner will ever pray

      In the matter of Petition of W G Powell for Guardianship
      of mrs Nannie Powell. It appearing that the three nearest adult
      relatives and all children of mrs Nannie Powell have been duly
      notified as required by law, and a Jury of six having been
      consulted to and authorized to pass upon the issues, and
      the Jury after being duly sworn as required by law re-
      turned their verdict as shown in the record finding
      that Mrs Nannie Powell is imbecile and needs a Guardian
      Wherefore it is considered ordered and adjudged that Mrs
      Nannie Powell is imbecile from old age and incapable of managing
      her estet, and no objections being filed to the appointment of
      W. G. Powell, and it appearing that Mrs Nannie Powell is a widow and
      that W G Powell is the oldest child and son of Mrs Nannie Powell. He the
      said W G Powell is hereby appointed Guardian of Mrs Nannie Powell, and
      bound in the sum of Eight Thousand Dollars.

    • Her tombstone next to that of her husband, shows the date listed above. However, her obituary, posted in the Post Search-Light on 22 July 1920, states that she died on "Saturday, July 10th."

      It is unclear why the stone would show this incorrect date, even if it was carved much later. An examination of the Bethel Church minutes might help clear this up.

      MRS. JESSE H. POWELL PASSED AWAY AT CYRENE, SATURDAY, JULY 10TH

      In the death of Mrs. Nannie Clay Powell, Cyrene and community have lost one of their most prominent citizens. As a result of a third strike of paralysis, the end came on Saturday afternoon, July 10th, at the home of her daughter, Mrs. J. B. Donalson, in Cyrene. The news of her death brought a shock to the community though she had been in very poor health for more than a year.

      Mrs. Powell was born and raised in Talbot county and shortly after the Civil War came to Decatur county with her two brothers, David and John Clay. In 1867 she was married to Mr. Jesse H. Powell, and together they established a home known by many for its royal hospitality and prominence in the upholding of the section and community. For forty years this Christian couple lived and taught by precept and example, the blessed truths of righteousness. No begging hand ever left this home empty nor was a deaf ear ever turned to a needy call. Two citizens have invested their lives in a most genuinely useful and helpful way than did this Godly couple. Since childhood, she had been an active and consistent member of the Baptist church. Nothing brought to her more pleasure than serving in some capacity for the progress and maintenance of her church.

      She leaves two sons, W. G. Powell, of Cyrene and J. T. Powell, of Brinson and eight daughters, Mrs. E. S. Perry, of Iron City; Mrs. E. Rich, Mrs. A. J. Rich, Mrs. J. B. L. Barber, of Bainbridge; Mrs. P. D. Rich, of Colquitt; Mrs. W. C. Sims, of Brinson; Mrs. J. B. Donalson, of Cyrene; Mrs. Walter Love, of Jacksonville, Fla.; more than thirty grandchildren and great-grandchildren loudly lament the loss of this admirable woman.

      Funeral services were held Sunday afternoon at Bethel church, conducted by her pastor, Rev. H. H. Shell, of Bainbridge. By six of her stalwart grandsons, her body was borne to the grave and there deposited by the side of her husband, who preceeded her several years."

    • Nancy was born in 1843 in Lee County, the part of which became Terrell County in 1856. I have not yet been able to determine precisely when her father Edmond moved from Wilkinson County to Lee County. It was after 1840, but before his death in about 1845. Lee County had a courthouse fire in the 1870s and few records are still available for the earlier periods. If anyone has records of this family's move, I would love to hear from you!

      Although Decatur County started filing death certificates in 1919, not all deaths were reported during those first few years. A death record was not found for a Nancy or Nannie Clay Powell in Decatur County where she was buried. Her joint tombstone with her second husband Jesse H. Powell showed a death date of 28 June 1920. She was not found in the 1920 census for Decatur County, nor was an obituary found for her near the supposed death date.

      In the general index to procedings of estates for Decatur County, Nannie Powell is listed with a death date of 10 Jul 1920. On my next visit I will search for an obituary near that date.

    • No marriage record is extant for Charles and Nannie. Lee County courthouse marriage records before 1867 were lost during courthouse fires in 1856 and 1872. A review of the microfilmed marriage records for Terrell County did not reveal a marriage for a Haynes/Clay couple any time between 1861-1865.

      Rigsby's "Historic Georgia Families" shows that Charles Haynes and Nancy Clay married Feb 1864 in Decatur County. The date might be correct, but they most likely married in Terrell or Lee County. A "C. E. Haynes" purchased a horse from the estate of Nancy's mother in May 1860 in Terrell County.

      Charles joined the Confederate Army in Terrell County, and died while in service. Therefore, it is not likely that Charles ever lived in Decatur County, and Nancy must have moved there after his death. Charles was in the same regiment in the Civil War as his future brother-in-law, David Henry Clay. In 1863, he was "home sick on furlough" in Terrell County, indicating that was his home.
