      State of North Carolina, County of Wilkes: I Elijah Nichols of the County and State aforesaid being of sound mind and memory but calling to mind the uncertainty of life do make and ordain this my last will and testament in manner and form following to wit.

      Item 1st: I will and bequeath to my son John Wesly Nichols a certain piece or parcel of land lying on the ucation[?] of Maiden-Cane Creek in Wilkes County known by the name of the James Kilby old place bounded as follows beginning on the north side of Maiden Cane Creek on a marked rock running a north direction along the fence through the field to a white oak in the woods near the top of the ridge thence to a spanish oak corner of mine made between me and John T. Edminston thence along a string of fence made by me and said Edminston a north westardly course to where my back big field fence joins said fence that comes from old M Smith's to a red oak on the out side in the fork of the fence then a north westardly direction crossing the ridge road to my own line on a chestnut, thence running with said line along the ridge road a south direction to a red oak saplin a corner made betwix'd me and said Edminston then with the line made between and said Edminston to a dead pine stump in said Edminston's field a south east direction then east about twelve rod down to the negro foot branch to a maple below the ford, then with a marked line below the path to a little red oak bush below said Edminston's Mill thence a south direction about three rods to a maple on the Bank of Maiden Cane Creek then with meanderings of the creek about one hundred yards or near it to my own line, then with the meanderings of said creek down to the beginning corner of a marked rock [entassing?] as is supposed one hundred and twenty five acres be the same more or less. Also in consideration that my son John W. Nichols lived with me for near two years after he was of age without any compensation and for all his kindness and attention to me and mine since he left me as well as for my love and affection for him I do give and bequeath to him the said John Nichols my negro boy named Henry aged about nine years to him and his heirs to have and hold said Boy Henry forever, and with these bequest, I will that he the said J W Nichols have no more of my estate.

      Item 2nd: I give and bequeath to my son Joseph A. Nichols a piece or parcel of land lying on Maiden Cain Creek, on the lower end of my home tract of land bounded as follows vz Beginning on a maple on the bank of the branch at the lower end of the Cooper field running a north west direction through a corner of the field up a stuppot(?) of the ridge following said ridge till it stricks the path on the top of the ridge at an old chestnut - then with the path a north direction towards Martin Faw's fence at the top of the hill then an east direction Martin Faw corner, then with said Faw line an east corse to the old wheat bottom line then south with said line to Maiden Cane Creek then up said creek to the maple the beginning corner containing as is supposed about sixty five acres be the same more or less.

      Item 3rd: I will that my wife Susan Elvira Nichols have and possess during her widowhood or during her life the following property and primicus[?] vz a cow and calf bed and bedstead cupbord and furniture a table the use and behoof[?] of the mill my dwilling horse and 67 Garden Stables and crib lots and still horse field to provide for and raise the children and at her death or remarriage I will and bequeath that all my home tract of land with its imoluments[?] go to my sons William and Elijah Saml by them to be equally divided between them.

      Item 4th: I will and bequeath that at my death all my personal property be sold and after paying all my debts behest[?] and I will and bequeath that my balances which may remain in the hands of my executors (hereafter named) and also that my executors rent out yearly the following fields vz the creek field below the mill, and the big field, and that they sell the proceeds and that they together with the above named dividends if any be equally divided among my following children the minors or divided due to minors being put at interest untill they become of age. vz Joseph Alfred, Violet Bullison, Jesse Lee, Jane McNiel, Polly, William, and Elijah Samuel.

      Item 5th: I will and bequeath that my executors (hereafter named) to pay out of any monies that may be on hand at the time of my death or out of the moneys arising from the sale of my personal property after my death five dollars in cash to the following of my children vz Joseph, Alfred, Violet, and Abram also I will that my daughter Susan Elvira and Polly have beds and bedsteds as Violet and Jane had when they left home.

      Item 6th: I will and appoint my faithful friends Allen Whitington A A Scroggs both of the County of Wilkes my executors to carry out in my stead this my last will and testament and I will that they be fully paid out of my estate for their service.

      In testimony whereof I have herewith set my hand and seal this the 21st day of April 1856.
