    • This twenty-seventh day of the third month in the year of our Lord one thousand eight hundred and eleven. I Jacob Hinshaw of Surry County and State of North Carolina being in a weak and low state of health but of perfect mind and memory and knowing the mortality of my body do make and ordain this to be my last will and testament touching such worldly estate wherewith it hath pleased God to bless me with in this life which I give and bequeath in the following manner and in the first place it is my will that all my just debts and funeral charges be first paid out of my personal estate.

      2nly It is also my will that my widow remain in full possession of the tract of land whereon I now live it being one hundred and twenty acres with the whole of my property in every kind to be at her disposal to enable her to raise my children during her widowhood but no longer at which time it is my will that my before mentioned tract of land with all the remainder of my property be sold and the amount of the sale to be equally divided between my widow Nancy Hinshaw and my four sons Eli, Jonathan, Benjamin, and William Hinshaw.

      3rdly I also give and bequeath unto my beloved wife Nancy Hinshaw all the monies coming to me from my father-in-law Benjamin Clanton's estate to her and her heirs forever.

      4thly I constitute and appoint my well beloved wife Nancy Hinshaw and trusty brother-in-law Joseph Carter my executors to this my last will and testament utterly revoking al and every other will and testament before this time made confirming this and no other to be my last will and testament. In witness thereof I have hereunto set my hand and seal the day above written.

      Thomas Vestal , DC, and William Cannon (two of the subscribing witnesses to the foregoing last will and testament of Jacob Hinshaw) made oath that they saw the said Jacob sign publish and declare the same to be his last will and testament that he was of sound and disposing mind and memory and at the same time they saw Benjamin Hinshaw sign the same as a witness thereto which was ordered to be recorded..................recorded accordingly by J Williams CC
