    • Last Will and Testament of Cecil H. Rich
      GEORGIA, DECATUR COUNTY
      I, CECIL H. RICH, of said State and County, and being of sound and disposing mind and memory, and hereby revoking all other Wills heretofore made by me, do make, publish and declare my Last Will and Testament as follows:
      ITEM I
      I desire that my body be buried in a Christianlike manner in keeping with my position in life, the details of which I leave to the members of my family.
      ITEM II
      I instruct and direct that my Executors hereinafter named pay all of my just and honest debts out of the proceeds of my Estate as soon as practical after my death.
      ITEM III
      After the payment of the debts of my Estate, including Estate taxes and the expenses of Administration, I will, bequeath and devise all of my property, whether real, personal, or mixed, and wherever situate, as follow[s]:
      (A) To R. L. Rich, Jr. and R. L. Rich, III, as Trustees, and upon the death or incapacity of R. L. Rich, Jr., the R. L. Rich, III, as sole Trustee, a 1/4 undivided interest, to hold, manage and distribute as follows:
      (1) The Trustees may pay the net income from the property currently to R. L. Rich, Jr., in such amounts and at such time as the Trustees deem necessary for the support in reasonable comfort of R. L. Rich, Jr. Any income not paid out or used currently shall be accumulated and added to the principal of the Trust.
      (2) The Trustees shall be authorized to incroach on the principal of this Trust in such amount as they may deem necessary in their judgment to provide for the support in reasonable comfort of R. L. Rich, Jr.
      (3) In addition to the provisions of subparagraphs (1) and (2) above, the Trustees shall pay over to R. L. Rich, Jr. such amount as he may in writing request, except that no such payment shal be made which would cause the aggregate payments from principal pursuant to this subsection (3) during any calendar year to exceed the greater of the following:
      (i) Five Thousand Dollars ($5,000.00), or
      (ii) Five percent (5%) of the aggregate value of the Trust.
      If R. L. Rich, Jr. fails to exercise his right during any calendar year, this right as to that calendar year shall lapse and shall not be cumulative.
      (4) R. L. Rich, Jr. shall have the power at any time and from time to time, by instrument in writing signed by him and delivered to the Trustees, or at his death by his Last Will and Testament, making express reference to this power, to direct the Trustees to turn over any part or all of the property in this Trust or to among such of his children, or descendants of deceased children, and in such manner, in Trust or otherwise, as R. L. Rich, Jr. may in such instrument direct or appoint, provided that he shall have no power to appoint such property to himself, to his Estate, to his creditors or to the creditors of his Estate.
      (5) Should R. L. Rich, Jr. fail to exercise his power of appointment as to all of the property of this Trust, or should he predecease me, then six (6) months after the death of the survivor of him or myself, all property then remaining in the Trust shall be divided into as many equal shares as R. L. Rich, Jr. shall have children then living and deceased children with descendants then living, and shall distribute one of said shares to each then living child of R. L. Rich, Jr., and one of said shares, per stripes, among the descendants then living of each deceased child of R. L. Rich, Jr., thus terminating this Trust.
      (B) To Cecil F. Rich and R. L. Rich, Jr., if he is living, and if not living, then to Jack G. Rich, as Trustees, a 1/4 undivided interest, to hold, manage and distribute as follows:
      (1) Trustees may pay the net income from the property currently to Cecil F. Rich in such amounts and at such time as the Trustees deem necessary for the support in reasonable comfort of Cecil F. Rich. Any income not paid out or used currently shall be accumulated and added to the principal of the Trust.
      (2) The Trustee shall be authorized to incroach on the principal of this Trust in such amount as they may deem necessary in their judgment to provide for the support in reasonable comfort of Cecil F. Rich.

      (5) Should Cecil F. Rich fail to exercise her power of appointment as to all of the property of this Trust, or should she predecease me, then (6) months after the death of the survivor of her or myself, all property then remaining in the Trust shall be divided into as many equal shares as I shall have children then living and deceased children with descendants then living, and shall distribute one of said shares to each then living child of mine, and one of said shares, per stirpes, among the descendants then living of each deceased child of mine, thus terminating this Trust.
      (C) To my daughter, Olive Rich Partee, a 1/4 undivided interest, per stirpes, absolutely and in fee simple.
      (D) To my son, Jack G. Rich, a 1/4 undivided interest, per stirpes, absolutely and in fee simple.
      ITEM IV
      I hereby designate and appoint R. L. Rich, Jr. and Jack G. Rich or the survivor of them, as the Co-Executors of this my Last Will and Testament, and R. L. Rich, Jr., Jack G. Rich and R. L. Rich, III, as Trustees of the Trusts herein created, and they shall, without order of any court, have the following rights, powers, privileges and immunities:
      (1) Sell or exchange trust or Estate property at public or private for cash or upon terms, with or without advertisement;
      (2) Improve or repair or lease (as lessor or lessee) any real estate and to grant or receive options to purchase property; and a lease or option may be made for a term that may extend beyond the period of the Trust or the Administration of the Estate;
      (3) Retain any property owned by me; to invest in stocks; bonds, loans, securities, or any other property, real or personal without regard to any statute or rule of law now or hereafter in force limiting the class of investments for fiduciary; and to do all of the same without obligation to diversify investments or liability for failure to diversify investments;
      (4) Borrow money for any purpose that the fiduciary may deem proper, and to secure such indebtedness by trust or loan deed, or otherwise;
      (5) Employ real estate brokers, attorneys, accountants or other expert assistants and to pay reasonable compensation from fiduciary funds for thei services;
      (6) Compromise or settle any and all claims for or against the Estate or the Trusts (or either); and to rescind or modify a contract affecting either, all in such manner and upon such terms as the fiduciary deems best;
      (7) Make division or distribution in kind or in money, or partly in kind and partly in money; and any asset distributed in kind need not be distributed pro rata or in fractional shares and beneficiaries;
      (8) Vote any stock by itself or by proxy; to enter into a plan or agreement for the sell, merger, consolidation, liquidation, recapitalization or other disposition of any Trust or Estate property or of any corporation issuing securities held as part of the trust or Estate, and to accept in such transaction any cash, securities or property that the fiduciary deems proper;
      (9) Calculate income from securities without amortizing all premiums at which they were acquired or accumulating the discount if such calculation is reasonable;
      (10) Provide reserves, from income otherwise distributable for depreciationm obsolescence, or other prospective loss, reduction in value, or casualty, if such reserve provisions or reaso[?]
      (11) Apportion all or part of any profit resulting from the sell of any asset between income and principal, if such apportionment is reasonable. It is intended the Trustees have such power so that it will not be necessary to seek court direction on routine allocations.
      (12) Exercise any and all options which I may own at my death, whether such options be to purchase stock (qualified, nonqualified, restricted or other), or whether such shall be op[?] to purchase other types or kinds of property;
      (13) Make, fail to make, or terminate any election permitted under the Internal Revenue Code (including any election under subchapter S of said Code);
      (14) Operate and continue any and all businesses, including proprietorships and partnerships in which I may have an interest or which I may be operating at the time of my death; to liquidate or join in the liquidation of any businesses, to sell or otherwise dispose of the same as going concerns, to incorporate or cause to be incorporated such businesses, to invest in any such businesses so incorporated as they shall see fit and to retain stock in any such businesses so incorporated without liability for depreciation in value, to become or remain a general or limited partner in m[?] new or continuing partnership and to take such other action as [?[uing the operation or liquidation od such business;
      (15) To employ agents and others and to authorize them to manage and operate such businesses, without liability for any of their actions or for any losses or liabilities of the business [?] the management is selected or retained with reasonable care. Any such agent or other person shall be paid such reasonable additional compensation by the business or by the Estate or Trust, or both [?] is commensurate with the time, effort and responsibility assumed by it in the management and operation of such business.
      (16) All Executors and all Trustees hereunder are relieved from any obligation to file or make any bond, inventory, appraisement, return or report to any court or individual whomsoever, but shall render annually a statement to income beneficiaries and [?] beneficiaries with vested interest showing the condition of the Estate and the receipts and disbursements during the preceding twelve (12) months.

    • "Cecil Harrell Rich, Sept. 21, 1900-Dec. 13, 1993
      Mrs. Cecil Harrell Rich, 93, of Bainbridge died on Dec. 13, 1993, at her residence. Services are today at 11 a.m. at First Presbyterian Church with Dr. Kenneth B. McKenzie officiating. Burial follows in Oak City Cemetery. Pallbearers are Harold Lambert, Jack Edwards, Joe Rich, Jimmy Partee, Chet Curnane, Billy English and Rusty Simpson. Honorary pallbearers are Elders of First Presbyterian Church.
      Mrs. Rich was born on Sept. 21, 1900, in Decatur County. She was a member of First Presbyterian Church. She was past president of the American Legion Auxiliary, former member of The Sportsman Club and was formerly active in her garden club. She is preceded in death by her husband, R. L. Rich Sr.
      She is survived by two sons, Robert Lloyd Rich, Jr. of Bainbridge and Jack Gray Rich of Tallahassee, Fla.; two daughters, Cecil Frances Rich of Santa Rosa Beach, Fla., and Olive Rich Partee of Stone Mountain; one brother, Charles L. Harrell of Yuma, Ariz.; two sisters, Jane H. Lambert of Bainbridge and Anne H. Curnane of Bellville, Ill.; nine grandchildren and 11 great-grandchildren.

    Notes 
    • Cecil was the oldest of seven children, having five sisters and a brother. Because her two youngest sisters were very young when she was first married, they called her "Tut" instead of Cecil. Their mother taught them that it was not proper for children to call a grown young lady by her first name, so the nickname "Tut" was adopted.

      Cecil loved gardening. She was active in her garden club and kept her house beautifully landscaped with roses, daylillies, and skillfully maintained shrubbery. She was also a good cook. One of her biggest hobbies, however, was sewing. She sewed clothes for herself, her children, and her grandchildren from patterns she purchased from the fabric store. She also loved knitting, crotcheting, and smocking. She had a separate sewing room in her house and she kept large quantities of buttons, yarn, thread, beads, and patterns, which all the grandchildren loved to play with. She let them cut paper dolls out of her old magazines and then showed them how to make clothes for them out of paper, fabric, buttons and beads.

      Cecil enjoyed watching several soap operas on television, which she referred to as her "stories." She knew what was going on with all the characters at all times. She likewise enjoyed keeping up with her rather large family and group of friends. She knew what everyone was up to, and was very knowledgeable of her family history. Cecil kept a weekly standing appointment at the beauty parlor to have her hair washed and curled. During this time, she caught up on what was going on in the lives of everyone in town.

      Cecil was very interested in medical remedies. She had a potion or ointment for almost any kind of ailment a person could imagine. Also, because she saved most everything she considered to be of some value, Cecil had many collections to share. She collected pictures, news articles, and other mementos on each of her children and grandchildren. At a special time in each of her loved ones' lives, she presented a whole scrapbook, filled with these treasures, to him or her. These scrapbooks have become cherished keepsakes to several of her descendants.

      Although she did not attend but one semester of college before she got married, Cecil was a good student in high school and was very proud of her high school grades. She often commented about how she made an A on her last algebra test. She was also involved with the studies of her children. One time she laughingly claimed that in a single week, she had attended a college graduation, a high school graduation, a grammar school graduation, and a kindergarten graduation - one for each of her children!

      A wedding of much social interest to the friends of both parties throughout the State, occurred in Thomasville on last Thursday night, when Miss Cecil Harrell was married to Mr. Lloyd Rich. This was a runaway marriage, the couple being motored to Thomasville by a friend. Immediately after the ceremony the bride and groom left for various points in Georgia for a several days honeymoon trip.
      The bride is the beautiful and attractive daughter of Mr. and Mrs. C. L. Harrell, who was one of the most popular young ladies in the younger society set in Bainbridge, groom is prominent in social and business circles and is connected with Rich Auto Supply Co.

      Mrs. Harold Wilson, of Greenville, S. C., who is the attractive guest of Mr. and Mrs. Lloyd Rich this week, was the honor guest at a lovely Coca Cola party this morning given by Mrs. Rich at her home on Shotwell Street.

      The living room, dining room and hall, open en suite, were beautifully decorated with white Iris, Azaleas, Narcissi and Jonquils.

      Around 35 guests were invited in to meet Mrs. Wilson.

    • R. L. Rich Chevrolet Co. To Give Powerglide Rides

      If you want to drive a Powerglide Chevrolet visit the showrooms of the R. L. Rich Chevrolet Company from June 18 to 30.

      R. L. Rich has set aside special demonstrators for use of the public and the period will be devoted to giving as many people as possible rides in the cars.

      Because of the customer demand for Powerglide automatic transmissions in this area, R. L. Rich explains, he has been unable to set aside demonstrators. However, he will hold cars solely for this purpose through the demonstration period.

      "Chevrolet has just built its 500,000th Powerglide and to observe the milestones it has requested all dealers to co-operate in mass demonstrations," he declared.

      Mr. Rich pointed out that Powerglide differs from other automatic transmissions on the market in that it represents a "package" improvement. Included, besides the revolutionary automatic shift, are a more powerful engine of 105 horse-power and an "Economiser" rear axle.

      "The opportunity for mass demonstrations here will show what owners have learned in more than a billion miles of driving," Mr. Rich declared. "Even a brief trial will prove that Powerglide-equipped cars are easier and more restful to drive.

      "With Powerglide, the car has no clutch. This means the climination of hundreds of manual operations in the course of an average day's driving. The result is that a driver finishes the day more refreshed and relaxed. A person has to experience the process of automatic Powerglide fully to appreciate its advantages.

      "We urge everyone not acquainted with Powerglide automatic transmission to visit our showrooms during the special demonstration period to find out for himself all the features of Powerglide automatic transmission."

      Mrs. R. L. Rich entertained at an informal party honoring her sister, Mrs. Sam Jenkins, and her niece, Miss Anne Jenkins of Tarboro, N. C. Tuesday morning.

      Shades of pink and rose zinnias were used in the living room and dining room and the halls were beautifully decorated with yellow zinnias and daisies.
